New York Child Custody and Visitation: Best Interests of the Child
In New York, there are two types of custody. Legal custody gives a parent the right to make decisions in the child's life, such as religion, school and medical care. Physical custody is where the child resides. When parents decide to share all of part of these responsibilities, it is called joint custody. The opposite of this is sole custody. The court will hold one standard above all others, and that is the "best interests of the child." This is the most important consideration the courts will make in determining child custody and visitation.
Custody Modifications
After the court has made a child custody and visitation order, it can later be modified. However, this requires a substantial change in circumstances, such as relocation or moving. In situations involving domestic violence, drug or alcohol abuse, modifications can also be made. However, court permission must be granted in order to make any modifications.
