New York No-Fault Divorce

Recently, New York has amended its divorce law to allow no-fault divorce under limited circumstances. No-fault divorce is only for those situations in which parties are able to find an amicable resolution to divorce issues such as child custody and visitation, property division and alimony. The divorce is considered "uncontested." In addition, parties must show that the marriage has been "irretrievably broken" for six months or more. This is usually proven if the parties have lived in separate residences for at least six months.

Fault Divorce

Unless parties can find a resolution to all custody and financial issues in a divorce, a no-fault divorce is not an option. The divorce is considered "contested." The parties must allege a proper "ground" for divorce such as:

  • Adultery
  • Abandonment
  • Inhumane treatment
  • Cruelty
  • Imprisonment
  • Living apart for one year
